The problem is that the Burroughs estate has grounds to sue people who try to make money off of John Carter of Mars.

Most indy creators would rather put all the time and effort it would require in dealing with the burroughs estates bullshit, on an IP they own complete rights to and don't have to worry that ERB inc. will sue them into oblivion.
