appeals are only about points of law and as they happened in the court room, not the merits of the case. You could straight up murder 10 people in broad day light on the 50 yard line of the superbowl and still have your case conviction overturned due to a issue in the court room. You would just get retried. In this case I doubt they bother being he is still in jail for 16 years as a 70 year old.
