This is true. To be fair, the Tesla galleries don't function like normal dealerships, which is why they aren't included. It isn't totally reasonable to cover them by the same franchise laws. But the real issue is that franchise laws are fucking stupid and if Republicans actually cared about The Free Market they would get rid of them.
They aren't though, Republicans are just conservative capitalists and so they want to maintain a status quo where they and their friends' sons own the dealerships and have a stranglehold on car sales.

It's not like Tesla is abusing a loophole. They operate galleries, not dealerships, and they don't operate the same. It's not an accident that they aren't being covered by the existing franchise laws. Walgreens isn't regulated as a hospital just because they sell adhesive bandages and aspirin; there are additional relevant factors that must be met.
